NOTICE OF SERVICE OF PROCESS BY PUBLICATIONNORTH CAROLINA MECKLEBURG COUNTY IN THE GENERAL COURT OF JUSTICE SUPERIOR COURT DIVISION 26CV004569-590CW RENTAL PROPERTIES LLC, CHRISTOPHER CASSITY, and SIMONE CASSIDY, Plaintiffs vs. M'KENNA INCORPORATED, DURR CAPITAL GROUP LLC, KINGDOM HOMES, LLC, REDBRICK CAPITAL, LLC, JAMES EDWARD MCLEAN, JR., Individually, and TREYVIAN DURR, a/k/a TREY DURR, Individually, Defendants TO: Durr Capital Group LLC ("Defendant DCC"), Kingdom Homes, LLC ("Defendant Kingdom"), and Treyvian Durr, a/k/a Trey Durr ("Defendant Durr") (collectively, the "Defendants") TAKE NOTICE that a complaint seeking relief against you has been filed in the above action. The nature of relief being sought is as follows: Judgment in favor of Plaintiffs and against Defendants, jointly and severally, in an amount to be determined at trial in excess of twenty-five thousand dollars ($25,000); An award of treble damages against Defendants, jointly and severally, of three times Plaintiffs' damages as proven at trial pursuant to N.C. Gen. Stat. § 75-16 and § 75-16.1; Temporary, preliminary, and permanent injunctive relief restraining Defendants from transferring, encumbering, or committing waste with respect to the Properties; A declaration that declares the avoidance of any voidable transfer, and such remedies as are authorized under North Carolina law including attachment, injunction, receiver (if warranted), and judgment against transferees for value; A trial by jury on all issues so triable; That the costs of this Action be taxed to the Defendants; and Such other and further relief as the Court deems just and proper. You are required to make a defense to such pleading no later than September 21st, 2026 (40 days from first date of publication of this Notice).
